Youth Climate Change Lawsuit Lacks Legal Standing To Proceed To Trial, Court Tosses Case

San Francisco, CA-

The lawsuit filed against the Federal government by a group of children and young adults, has been tossed out.

“We are suing because none of us and none of you have time to wait,” Kelsey Juliana, the lead plaintiff in the case, shared in 2017. It was originally filed against President Obama’s administration in 2015. The lawsuit then shifted to the Trump administration.

In a 2-1 decision, the court found that it is dire situation concerning global warming. Unfortunately, there just isn’t a case strong enough for a lawsuit. Judge Josephine Staton shared, “the government accepts as fact that the United States has reached a tipping point crying out for a concerted response—yet presses ahead toward calamity.”

She continued, “its as if an asteroid were barreling toward Earth and the government decided to shut down our only defenses,” she added. “Seeking to quash this suit, the government bluntly insists that it has the absolute and unreviewable power to destroy the Nation.”
